DMCA Policy – Action Sports Maui

This Digital Millennium Copyright Act (“DMCA”) Policy explains how Action Sports Maui
(“Action Sports Maui,” “we,” “our,” or “us”) responds to claims of copyright infringement
on ActionSportsMaui.com and any related content, including text, images,
videos, and downloadable materials.

We respect the intellectual property rights of others and expect our users, partners, and
affiliates to do the same. In accordance with the DMCA, 17 U.S.C. §512, we will promptly
respond to properly formatted notices of alleged infringement.

2. Filing a DMCA Takedown Notice

ActionSportsMaui.com without authorization, you may submit a written DMCA
takedown notice that includes all of the following information:

  1. A physical or electronic signature of the person authorized to act on behalf of the owner
    of the allegedly infringed copyright.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple
    works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of
    infringing activity, and information reasonably sufficient to permit us to locate the
    material (for example, a direct URL to the specific page or image).
  4. Information reasonably sufficient to allow us to contact you, such as your name, mailing
    address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use of the material is
    not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of
    perjury, that you are the copyright owner or are authorized to act on behalf of the
    copyright owner.

Incomplete notices may delay our ability to respond. Where appropriate, we may request
additional information to verify your claim.

3. What Happens After We Receive a Valid Notice

Upon receipt of a valid DMCA takedown notice, Action Sports Maui may:

  • Remove or disable access to the allegedly infringing material;
  • Notify the user or content provider who posted the material;
  • In appropriate cases, terminate or restrict access for repeat infringers, in accordance
    with our policies and applicable law.

We may also retain a copy of your notice for record-keeping purposes.

4. Submitting a DMCA Counter-Notice

If your material has been removed or disabled as a result of a DMCA takedown notice and you
believe this removal was a mistake or misidentification, you may submit a written DMCA
counter-notice to our DMCA Agent that includes all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been
    disabled, and the location at which the material appeared before it was removed or
    access to it was disabled (for example, the specific URL).
  3. A statement under penalty of perjury that you have a good-faith belief that the material
    was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal district court for the
    judicial district in which your address is located (or, if you are outside the United
    States, that you consent to the jurisdiction of the courts located in the State of
    Hawaii), and that you will accept service of process from the person who provided the
    original DMCA takedown notice or that person’s agent.

If we receive a valid counter-notice, we may restore the material in accordance with the
DMCA unless the original complainant notifies us that they have filed a court action
seeking to restrain you from engaging in infringing activity related to the material in
question.

5. Repeat Infringer Policy

Action Sports Maui may, in its sole discretion and where legally required, suspend or
terminate access for users who are determined to be repeat infringers of copyrighted
material. We may also remove any content that appears to infringe the rights of others,
whether or not we receive a formal DMCA notice.

6. Misrepresentations

Under the DMCA, any person who knowingly makes material misrepresentations in a notice of
infringement or in a counter-notice may be liable for damages, including costs and
attorneys’ fees, incurred by the alleged infringer, the copyright owner, or service
providers such as Action Sports Maui.

Please ensure that you have a legitimate basis before submitting a DMCA notice or
counter-notice.

7. Changes to This DMCA Policy

We may update this DMCA Policy from time to time to reflect changes in law, our practices,
or our services. Any updates will be posted on this page with a revised “Last Updated”
date. Your continued use of ActionSportsMaui.com after such changes constitutes your
acceptance of the updated policy.
