Assumption of Risk

Engaging in outdoor activities and water sports carries inherent risks. Participants must acknowledge and accept these risks. Using any watersports equipment requires proper skill and safety training. By purchasing, renting, or using equipment and/or products from Maui Sports Unlimited LLC, dba Action Sports Maui (“ASM”), you assume all risk and responsibility for any damage or injury that may result. ASM assumes no liability for the use of any equipment and/or products. By purchasing or using equipment from ASM, you acknowledge and accept this release of liability.

Payment Policy

All lessons should be prepaid. If a credit card is provided to hold a lesson, it will typically be charged in full before the lesson. We accept various forms of payment, including major credit cards, to facilitate a seamless booking process.

Cancellation and Rescheduling Policy

We understand that plans can change. If you need to cancel or reschedule your lesson, please notify us at least 24 hours in advance. Cancellations made within this timeframe may be eligible for a refund or rescheduling. Late cancellations or no-shows may be subject to a fee or forfeiture of payment. Our goal is to accommodate your needs while ensuring availability for all our guests.

Safety and Conduct

Safety is our top priority. Participants are expected to follow all safety instructions provided by our instructors and staff. Failure to adhere to safety guidelines may result in the termination of the activity without a refund. We reserve the right to refuse service to individuals who are under the influence of alcohol or drugs, or whose behavior poses a risk to themselves or others.

Equipment Usage

We provide all necessary equipment for your chosen activity. Participants are responsible for the proper use and care of the equipment during the lesson. Any damage to or loss of equipment due to negligence may result in additional charges. Our equipment is regularly inspected and maintained to ensure safety and performance.

Health and Fitness Requirements

Participants should be in good health and possess a basic level of fitness appropriate for the chosen activity. Certain medical conditions may require a doctor’s clearance. Please inform us of any relevant health issues or concerns prior to your lesson. Your well-being is important to us, and we strive to provide a safe experience for all participants.
